1. Introduction

AutogramStudio ("we," "our," or "us") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA") and applicable international copyright laws, we have adopted this policy for responding to claims of copyright infringement on our platform.

This DMCA Policy applies to all content hosted on or transmitted through the AutogramStudio platform, including but not limited to: AI Marketplace listings, mini app content, bot media, bio link pages, channel store listings, forwarded content, user profile information, and any other user-generated content.

If you believe that your copyrighted work has been copied, used, or otherwise infringed upon on our Platform in a way that constitutes copyright infringement, please follow the procedures outlined in this policy to notify us.

2. How to Submit a DMCA Takedown Notice

If you are a copyright owner (or an agent authorized to act on behalf of a copyright owner) and believe that content on our Platform infringes your copyright, you may submit a DMCA takedown notice to our designated agent. To be effective, your notification must be a written communication that includes the following information:

  • 1. Physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • 2. Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single notification, provide a representative list of such works.
  • 3. Identification of the allegedly infringing material and its location on our Platform. Provide specific URLs, listing IDs, or other information sufficient for us to locate the material (e.g., "Marketplace listing #12345" or "Bio page at autogramstudio.com/bio/username").
  • 4. Your contact information, including your full legal name, mailing address, telephone number, and email address.
  • 5. A statement of good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • 6. A statement under penalty of perjury that the information in the notification is accurate and that you are the copyright owner or authorized to act on behalf of the owner.

⚠️ Warning: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorney's fees incurred by the alleged infringer or by us. Please ensure that you actually have the rights you are claiming before submitting a DMCA notice.

4. Our Response to DMCA Notices

Upon receiving a valid, complete DMCA takedown notice, we will take the following actions:

  • 1. Review: We will review the notice to confirm it contains all required elements and appears to be valid.
  • 2. Removal: We will promptly remove or disable access to the allegedly infringing material, typically within 24-72 hours of receiving a valid notice.
  • 3. Notification: We will notify the user who posted the content about the takedown notice, providing them with a copy of the notice and information about their right to file a counter-notification.
  • 4. Documentation: We will maintain records of all DMCA notices received and actions taken.

If the removed content was a marketplace listing with an active escrow transaction, the escrowed funds will be held pending resolution. Buyers will be notified of the situation and may receive a refund depending on the outcome.

5. Counter-Notification (Counter-Notice)

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification. A valid counter-notification must include:

  • 1. Your physical or electronic signature.
  • 2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed.
  • 3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  • 4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the courts in your district and that you will accept service of process from the person who filed the original DMCA notice or their agent.

Upon receiving a valid counter-notification, we will:

  • •Forward the counter-notice to the original complainant.
  • •Inform the complainant that we will restore the removed content in 10-14 business days.
  • •Restore the removed content unless we receive notice from the complainant that they have filed a court action to restrain the user from engaging in infringing activity.

6. Repeat Infringer Policy

AutogramStudio maintains a strict repeat infringer policy in accordance with the DMCA. We will take the following graduated actions against users who repeatedly infringe copyrights:

First Offense — Warning

The infringing content is removed and the user receives a formal warning via email and in-app notification. A strike is recorded on the user's account.

Second Offense — Temporary Restriction

The content is removed and the user's ability to upload new content, create marketplace listings, or publish bio pages is temporarily suspended for 30 days.

Third Offense — Account Termination

The user's account is permanently terminated. All content, listings, and services associated with the account will be removed. Wallet balances may be forfeited subject to applicable law.

We reserve the right to skip directly to account termination for severe or egregious cases of copyright infringement, or where the infringement involves commercial-scale piracy of copyrighted works.

7. Platform-Specific Considerations

7.1 AI Marketplace Listings

Sellers on the AI Marketplace are responsible for ensuring they have the right to sell the products and services they list. Copyright infringement on marketplace listings will be treated seriously. If a listing is removed due to a DMCA takedown, any active escrow transactions will be reviewed, and buyers may receive a full refund.

7.2 Bot & Mini App Content

Users are responsible for the content distributed through bots and mini apps created on our Platform. This includes images, text, media files, and any other copyrighted material. Copyright claims against bot or mini app content will be handled under the same DMCA procedures.

7.3 Auto-Forwarded Content

Content forwarded through our Auto-Forward system originates from third-party Telegram channels and groups. While we do not create or edit forwarded content, we will cooperate with valid DMCA requests regarding forwarded material by disabling the relevant forwarding rules.

7.4 Bio Link Pages

Bio link pages may contain images, descriptions, and links that could potentially involve copyrighted material. Users are responsible for ensuring they have the right to use all content on their bio pages, including profile images, brand logos, and product imagery.

7.5 Channel Store

Channel store listings include descriptions and promotional content about Telegram channels. If a channel store listing uses copyrighted material (such as unauthorized brand logos or copyrighted descriptions), it may be subject to DMCA takedown.

8. Good Faith & Fair Use

Before submitting a DMCA notice, please consider whether the use of the copyrighted material may qualify as fair use under Section 107 of the Copyright Act, which permits limited use of copyrighted material for purposes such as commentary, criticism, news reporting, teaching, scholarship, and research.

We encourage copyright owners and users to resolve disputes amicably when possible. If you are unsure whether the use of your copyrighted work on our Platform constitutes infringement, we recommend consulting with an attorney before submitting a DMCA notice.

9. Limitation of Liability

AutogramStudio acts as an intermediary platform and does not pre-screen or review all user-generated content for copyright compliance. We are not liable for copyright infringement by our users. We respond promptly to valid DMCA notices and take appropriate action as outlined in this policy.

We reserve the right to remove any content that we believe, in our sole discretion, may infringe the intellectual property rights of others, even in the absence of a formal DMCA notice.
